This document contains information about the entity Murrumbateman Landcare Group Incorporated. It includes ABN, entity type, GST status, ACNC registration and DGR status. Note that MLG is classified as an "Other Incorporated Entity" which is an entity that has the same characteristics as a company but is not incorporated as a corporation's law company. MLG is an incorporated associations under NSW Associations Incorporation Act 2009.
MLG is an association incorporated under the Associations Incorporation Act 2009, administered by NSW Fair Trading. The main impetus for revising the Murrumbateman Landcare Group (MLG) constitution at this time is a taxation policy change applying to the 2023-24 financial year. The change requires non-profit organisations such as ours to be registered as charities in order to be tax exempt. In order to be registered as a charity, we need to add some information to our constitution regarding our objectives and non-profit status. The revised 2024 MLG constitution is based on NSW Fair Trading’s 2022 model constitution, with amendments of four types: • changes to governance documentation required so that Murrumbateman Landcare Group Inc can register to become a charity with the Australian Charities and Not-for-profits Commission. • changes to governance documentation that will allow us to apply for DGR status with the ATO. • changes to the 2010 Fair Trading model constitution passed by special resolution at the 2012 MLG Annual General Meeting and then applied to the 2022 model constitution, and • other changes that reflect current MLG practice.
The Murrumbateman Landcare Group constitution is based on the Model constitution 2010 prepared by NSW Fair Trading and amended to suit MLG in 2012. It was further amended slightly in 2022 to match the mandatory changes introduced by NSW Fair Trading to the model constitution in 2022.
